This is a legal document, and by acknowledging, you do give up rights and waive the ability to sue if you are injured as a result of your participation in this Recovery Evening Wind Down. In this document, Bliss Out Holdings LLC is in reference to Recovery Evening Wind Down’s parent company and any and all subsidiary companies under Bliss Out Holdings LLC.
I acknowledge that my participation in this Recovery Evening Wind Down wellness program is expressly conditioned on my agreement to each of the terms of this document. I acknowledge and agree as follows:
General Acknowledgment
I understand that the programs I am participating in may not be suitable for the general population. There are potential risks associated with participation in any wellness program. I understand that it is my responsibility to obtain the approval of my physician before participating in any new wellness routine or regimen. I hereby certify that I accept any risk of illness or injury as a result of my participation in this program.
I hereby confirm that I am a participant in these programs of my own free will.
Additionally, I acknowledge that this Recovery Evening Wind Down wellness program is not therapeutic; it is not a cure for any medical condition, nor a substitute for other treatments. I hereby release and hold harmless Bliss Out Holdings LLC and its subsidiary companies, all program host organizations and its and their instructors, agents, employees, independent contractors, directors, and volunteers from any and all liability, damage, expense, causes of action, suits, claims, or judgments arising from injury, damage, or loss to me or my personal property, my aides, family or other friends who may accompany me, and which may arise in whole or in part out of my participation in these programs. I understand that my registration can be revoked at any time with or without cause by Bliss Out Holdings LLC.
I understand that the facilitator of the program I attend is not a doctor or any kind of therapist licensed in Washington State. I acknowledge that they are providing services in a role as a Wellness Coach only and not as a doctor or therapist. The Wellness Program they facilitate is NOT therapy or the practice of medicine. If you would like individualized therapy or medical diagnosis for your specific needs, please consult with your physician.
Online Classes and Coaching
I understand that if I am participating in an online program and turn on my video, that others will see me and possibly other images that are picked up by my computer or device’s camera.
About Recording of classes: Bliss Out Holdings LLC online classes will be recorded for evaluation and other purposes including but not limited to use on Bliss Out Holdings LLC website. I understand that my likeness, my voice asking questions or providing comments may appear in the video. I authorize use of my image and likeness for the use in these recordings that may be offered for free or sold to future participants with Bliss Out Holdings LLC.
Assumption of Risk
Assumption of Risk. I AGREE THAT MY PARTICIPATION IN THIS WELLNESS PROGRAM, WHETHER I TAKE PART IN ACTIVITIES ON A GROUP OR INDIVIDUAL BASIS, IS AT MY OWN RISK. I UNDERSTAND THAT TAKING PART IN PHYSICAL EXERCISE, SPORT, FITNESS, NUTRITIONAL AND OTHER WELLNESS BASED ACTIVITIES COMES WITH AN INHERENT RISK OF INJURY, DAMAGE, ILLNESS, OR LOSS. I WAIVE MY RIGHT TO FILE A LAWSUIT AGAINST BLISS OUT HOLDINGS LLC FOR ANY INJURY OR LOSS RESULTING FROM WELLNESS PROGRAM ACTIVITY. I ALSO RELEASE AND HOLD HARMLESS Recovery Evening Wind Down COACHES AND CONSULTANTS FROM ANY CLAIM OR LAWSUIT FOR PERSONAL INJURY, DAMAGE, OR WRONGFUL DEATH, BY ME, MY FAMILY, ESTATE, HEIRS, OR ASSIGNS, ARISING OUT OF PARTICIPATION IN THE WELLNESS PROGRAM, INCLUDING BOTH CLAIMS ARISING DURING THE WELLNESS PROGRAM ACTIVITY AND AFTER I COMPLETE THE WELLNESS PROGRAM ACTIVITY, AND INCLUDING CLAIMS BASED ON NEGLIGENCE OF OTHER PARTICIPANTS, WHETHER PASSIVE OR ACTIVE.
No Warranties. I FURTHER UNDERSTAND AND AGREE THAT BLISS OUT HOLDINGS LLC MAKES NO WARRANTIES, EXPRESS OR IMPLIED, AS TO THE WELLNESS PROGRAM, THE PROPERTY OR ONLINE PLATFORM ON WHICH THE WELLNESS PROGRAM WILL TAKE PLACE, ANY PERSONS IN ATTENDANCE AT WELLNESS PROGRAM ACTIVITIES, WHETHER I HAVE ANY HEALTH LIMITATIONS THAT WOULD PRECLUDE MY PARTICIPATION IN THE WELLNESS PROGRAM, OR ANY OTHER WARRANTY, CONDITION, GUARANTY, OR REPRESENTATION, WHETHER ORAL, WRITTEN, OR IN ELECTRONIC FORM, RELATING TO THE WELLNESS PROGRAM.
Personal Responsibility. Bliss Out Holdings LLC has advised me to consult a physician before I undertake any physical, mental, or nutrition based wellness program. To the best of my knowledge, I am in sufficient physical and emotional condition to participate in the Wellness Program. I will read and follow the rules for any activities that I participate in, including following the directions for any tea or herb to drink or activity to complete and other tools and resources shared with me, and will follow the rules or instructions to the best of my ability. I understand that the Wellness Program does not provide medical advice or diagnosis and is not intended as a substitute for a licensed physician or therapist.
Miscellaneous. In the event any provision of this Wellness Program Waiver and Relief of Liability Form is found to be legally invalid or unenforceable for any reason, all remaining provisions will remain in full force and effect. This Wellness Program Waiver and Release of Liability is binding upon me as well as my heirs, children, personal representatives, or anyone else entitled to act on my behalf.
Acceptance
If the terms of this Agreement are acceptable, please confirm acceptance by checking the box before purchase. By doing so, I acknowledge that: (1) I have received a copy of this letter agreement; (2) I have had an opportunity to discuss the contents with Bliss Out Holdings LLC, and I have had the opportunity to review it with an attorney if I desired to do so. I understand, accept and agree to abide by the terms hereof.
